1. Acceptance of Terms
These Terms of Service (the “Terms”) govern your access to and use of TopCut London (the “Service”), operated by Daniel from London, United Kingdom. By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use TopCut London.
2. Service Description
TopCut London is a community platform built for UK-based Pokémon Trading Card Game players. We provide tools to track your card collection, log tournament results, build a wishlist, and follow upcoming sets, alongside related features that may evolve over time.
TopCut London is an independent project. We are not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, Game Freak, Creatures Inc., or any of their subsidiaries or partners. All references to Pokémon and the Pokémon TCG are made for descriptive, non-commercial community purposes.
3. Account Registration
To use most features of the Service you need a TopCut London account. You agree to provide accurate, current, and complete information when you sign up, and to keep that information up to date. You are responsible for maintaining the confidentiality of your password and for all activity that takes place under your account.
You must be at least 13 years of age to create an account. By registering you confirm that you meet this age requirement. Each person may register only one account; multiple accounts created by the same individual may be suspended or merged at our discretion.
Please notify us immediately at help@topcutlondon.com if you suspect unauthorised use of your account.
4. Acceptable Use
You agree to use TopCut London respectfully and lawfully. In particular, you must not abuse, harass, threaten, defame, or otherwise harm other users or our team. Behaviour that targets individuals or groups based on race, gender, sexuality, religion, or disability will not be tolerated.
You must not attempt to hack, reverse engineer, scrape at scale, probe for vulnerabilities, disrupt, or otherwise damage the platform or the infrastructure it runs on. You must not use the Service to distribute malware, send unsolicited communications, or perform any activity that violates UK law.
The Service is intended for personal, non-commercial use by hobbyists. You may not use TopCut London for commercial purposes — for example, large-scale price scraping, automated reselling tooling, or running a paid service on top of our data — without our prior written permission.
You agree not to submit false or misleading information, including fraudulent tournament results, fake collection data designed to manipulate public-facing displays, or feedback submitted in bad faith.
5. Content and Data
You retain ownership of the content you submit to TopCut London, including your collection data, tournament logs, wishlist entries, and feedback (“Your Content”). We do not claim copyright in Your Content.
By submitting Your Content, you grant TopCut London a non-exclusive, worldwide, royalty-free licence to store, process, and display it as required to operate the Service for you — for example, to render your collection back to you, to compute statistics, or, where you have chosen to share something publicly, to display it to other users. This licence ends when you delete the relevant content or your account, except to the extent we are required to retain copies for legal or backup purposes.
We reserve the right to remove or hide any content that, in our reasonable judgement, violates these Terms, infringes the rights of others, or is otherwise harmful to the community. Where appropriate we will notify the affected user.
6. Pokémon TCG Content
Card images, card names, set names, and other Pokémon-related assets that appear on the Service are the property of The Pokémon Company, Nintendo, Game Freak, Creatures Inc., and their respective licensors. They are used on TopCut London under fair-dealing principles for non-commercial, community-oriented purposes such as helping players catalogue and discuss their collections.
TopCut London makes no claim of ownership over any Pokémon intellectual property and is not affiliated with the rights holders. If you are a rights holder and have a concern about how content is used on the Service, please contact us at help@topcutlondon.com.
7. Termination
We reserve the right to suspend or terminate your access to TopCut London, in whole or in part, at any time and without prior notice if we reasonably believe you have breached these Terms or engaged in conduct that puts the Service or its users at risk.
You may stop using the Service and close your account at any time via your account settings or by emailing us at help@topcutlondon.com. On account closure we will delete or anonymise your personal data in accordance with our Privacy Policy.
8. Disclaimer of Warranty
TopCut London is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from bugs, and we make no guarantees of uptime or fitness for any particular purpose.
You use the Service at your own risk. While we work hard to keep TopCut London running smoothly, occasional outages, data inconsistencies, or incorrect information (for example, in upcoming-set listings or pricing references) can occur, and you should not rely on the Service for mission-critical or commercial decisions.
9. Limitation of Liability
To the maximum extent permitted by law, TopCut London and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising from or relating to your use of the Service.
Our total aggregate liability to you for any claim arising out of or in connection with these Terms or the Service, regardless of the form of the action, is limited to £10 (ten pounds sterling). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under English law, such as liability for death or personal injury caused by negligence or for fraud.
10. Governing Law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by, and construed in accordance with, the laws of England and Wales.
You and TopCut London irrevocably agree that the courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim.
11. Changes
We may update these Terms from time to time, for example to reflect new features, changes to the law, or feedback from the community. When we do, we will revise the “Last updated” date at the top of this page.
Where the changes are material, we will let registered users know in advance by email. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the new Terms. If you do not agree to the changes, you should stop using the Service and may close your account.
